Terms of service

1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and Luxe Link, Inc. ("Luxe Link," "we," "us"), based in Santa Monica, California. They cover your use of www.luxelink.com (the "Site") and any purchase you make through it. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Our Privacy Policy and our Shipping and Returns policy are part of these Terms.

2. Changes to these terms

We may update these Terms at any time by posting a new version on this page with a new effective date. If you keep using the Site after we post changes, you accept them. The Terms in effect when you place an order apply to that order.

3. Who can use the Site

You must be at least 18 years old, or the age of majority where you live, to buy from the Site. Younger visitors may use the Site only with the involvement of a parent or guardian. You agree to use the Site only for lawful, personal or business purposes.

4. Your account

If you use a customer account, keep your sign-in details private. You are responsible for activity under your account. Give us accurate information and keep it up to date. We may suspend or close an account that breaks these Terms.

5. Products, orders and payment

  • Product details. We describe and photograph our products as accurately as we can. Colors, finishes and crystal sparkle can look different on different screens, and we do not guarantee that your screen shows them exactly.
  • Availability. Products are available while stock lasts. A product shown on the Site may sell out at any time.
  • Orders. Your order is an offer to buy, and we accept it when we ship it. We may refuse or cancel any order, including orders we suspect are fraudulent and orders affected by a pricing or description error. We may limit the quantity per order or per customer. If we cancel an order you already paid for, we refund you in full.
  • Prices. Prices are in U.S. dollars unless shown otherwise at checkout, and may change at any time. Taxes and shipping are added at checkout. If a price on the Site is wrong, we may correct it and give you the choice to confirm or cancel your order.
  • Payment. Payments are processed on Shopify's checkout by our payment processors, including Shopify Payments and Shop Pay. We do not store your full card number. You confirm that you are authorized to use the payment method you provide.
  • Discount codes and promotions are subject to the terms shown with each offer and can't be redeemed for cash.

6. Shipping and delivery

We ship from California. Delivery times shown on the Site are estimates, not guarantees. Ownership of and risk of loss for your order pass to you when we hand it to the carrier. For international orders, you are responsible for any import duties, taxes and fees not collected at checkout. If your order arrives damaged or does not arrive, contact us and we will help. 7. Returns and refunds

Returns, exchanges and refunds follow the Shipping and Returns policy posted on the Site when you place your order.

8. Using our products safely

Our purse hooks are made to hold a handbag at the edge of a table or counter. Follow the instructions on our How to Use page. Make sure the surface is stable and suitable before you hang a bag, and do not hang anything too heavy for the hook or the surface. Do not leave valuable or fragile items unattended on a hook. Our products are accessories, not toys. Some designs include small decorative parts, so keep them away from young children. To the fullest extent permitted by law, we are not responsible for damage or injury caused by using a product other than as intended.

9. Wholesale and Ambassador programs

Wholesale accounts and our Ambassador/Affiliate program are governed by separate terms that we give you if your application is accepted. If those terms conflict with these Terms, the program terms apply to the program.

10. Intellectual property

The Site and its content, including text, photos, videos, graphics, product designs, the Luxe Link name and logo, and the look of the Site, belong to Luxe Link or our licensors and are protected by copyright, trademark and patent laws. Luxe Link purse hooks are protected by U.S. Patents 7,644,900 and 8,061,669. Other names, characters, artwork and trademarks shown on the Site belong to their owners.

We give you a limited, revocable, non-transferable permission to view the Site for your personal use. You may not copy, reproduce, republish, scrape or use any part of the Site for commercial purposes without our written permission.

11. Reviews and other content you submit

When you post a review or send us content such as photos, comments or application details, you keep ownership of it. You give Luxe Link a perpetual, worldwide, royalty-free license to use, display, reproduce, edit and share it in connection with our business, including on the Site, in emails and on social media. You confirm that your content is your own, is accurate, is lawful and does not infringe anyone's rights. We may remove any content at our discretion. Reviews and other submissions reflect the views of the people who post them, not Luxe Link, and we are not responsible for them.

12. Acceptable use

You agree not to:

  • use the Site for any unlawful purpose, or to break these Terms;
  • try to gain unauthorized access to the Site, its systems or other people's accounts, or test the Site for weaknesses;
  • scrape, crawl or collect data from the Site by automated means;
  • interfere with how the Site works, or upload viruses or other harmful code;
  • impersonate anyone, or misrepresent your connection to anyone;
  • buy products for resale without a wholesale agreement with us.

13. Information on the Site

Content on the Site, including our How to Use page, FAQ and journal, is general information provided for your convenience. We try to keep it accurate and current, but it may contain errors or be out of date, and we may change prices, product details and availability without notice.

14. Third-party links and services

The Site links to and includes services from other companies, such as Shopify's checkout, Shop Pay, our Instagram feed, Judge.me reviews, and our pages on Instagram, Facebook and Pinterest. We do not control these services and are not responsible for their content, policies or practices. Your use of them is at your own risk and subject to their own terms.

15. Disclaimer of warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. TO THE FULLEST EXTENT PERMITTED BY LAW, AND EXCEPT AS EXPRESSLY STATED IN OUR SHIPPING AND RETURNS POLICY, WE DISCLAIM ALL WARRANTIES FOR PRODUCTS SOLD THROUGH THE SITE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LUXE LINK, INC. AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR ANY PRODUCT, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS, THE SITE OR ANY PRODUCT IS LIMITED TO THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY APPLY TO YOU ONLY TO THE EXTENT THE LAW ALLOWS.

17. Indemnification

You agree to defend, indemnify and hold harmless Luxe Link, Inc. and its owners, officers, employees and agents from any claims, damages, losses and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the Site, content you submit, or your violation of any law or anyone else's rights.

18. Suspension and termination

We may suspend or end your access to the Site at any time, without notice, if we believe you have broken these Terms or harmed Luxe Link or other customers. The sections on intellectual property, content you submit, disclaimers, limitation of liability, indemnification and governing law continue to apply after termination.

19. Governing law and where disputes are heard

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms, the Site or a purchase will be heard only in the state or federal courts located in Los Angeles County, California, and you agree to the jurisdiction of those courts. Before filing a claim, please contact us first so we can try to resolve the issue informally.

20. Other terms

If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a provision right away, we have not waived it. These Terms, together with the policies they include, are the entire agreement between you and Luxe Link about the Site. We may transfer our rights under these Terms; you may not transfer yours without our written consent. Section headings are for convenience only.
